The Circuit Court for Burnett County, Wisconsin granted summary judgment on behalf of HKM’s client, an independent contractor and his major insurance carrier, on an issue of first impression within the state.
HKM Attorneys Obtain Summary Judgment on Non-Exposure Grounds in Mesothelioma Case
HKM lawyers Pete Wanning, John Wells and Ryan Brackin recently obtained an order granting their client's motion for summary judgment in a wrongful death mesothelioma case pending in Ramsey County, Minnesota. The case involved a former foundry employee who claimed he worked with and around asbestos-containing products and equipment, which he alleged caused him to develop mesothelioma. HKM represented a foundry supply company in the litigation.

The case involved a career field representative and draftsman for the railroad industry who alleged to have developed mesothelioma after working with and around a variety of asbestos-containing materials and equipment.

HKM trial attorney Casey Suszynski recently obtained a favorable Wisconsin Court of Appeals decision on behalf of the firm's client, a major insurer. The circuit court initially granted HKM's motion for summary judgment in the case, finding HKM's client did not have a duty to defend or indemnify an insured under a commercial general liability policy, and the Wisconsin Court of Appeals affirmed the summary judgment decision.

HKM Secures Favorable Decision at the Minnesota Supreme Court
HKM attorneys Kelly Hadac and Mike Mather recently secured a favorable decision on behalf of a firm client before the Minnesota Supreme Court. After the district court granted the firm’s client summary judgment on a promissory note, the defendant requested that the court stay entry of judgment pending resolution of a separate lawsuit between the same and additional parties. The district court granted the defendant’s motion, finding sufficient commonalities between the two cases to merit a stay.

HKM Attorneys Secure Defense Verdict in Wisconsin Mud Racing Personal Injury Jury Trial
HKM trial attorneys Krista Pezewski and Casey Suszynski recently secured a defense verdict in a multi-million dollar personal injury case venued in Eau Claire County, Wisconsin. The case involved five Plaintiffs who attended a mud race at a venue located just outside Eau Claire. All five sustained injuries when a mud racing vehicle left the mud racing track and entered the area where they were observing the race. The Plaintiffs’ injuries varied from minor to severe.
